1. Agreement to these Terms
Tikou is a service operated by TonSync Studio LLC, a Wyoming limited liability company ("Tikou", "we", "us"). Tikou operates the website at tikou.org (the "Service"), which sells access to digital practice-exam content. By creating an account, purchasing, or otherwise using the Service, you agree to these Terms of Service and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to buy from or use the Service. The Service is intended for users in the United States.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information; if your name or email changes, contact us at support@tikou.org to update it. Tell us promptly at support@tikou.org if you suspect unauthorized use.
4. What you are buying
A purchase grants you a personal, non-exclusive, non-transferable, revocable license to access and use the purchased practice-exam content for your own exam preparation. It is not a sale of the content itself. Access is for your individual use only.
5. Prohibited uses
You may not: (a) copy, reproduce, republish, sell, resell, sublicense, distribute, or publicly display any part of the content; (b) share your account or purchased content with others; (c) scrape, harvest, or bulk-download the content by any automated means; (d) reverse-engineer or interfere with the Service; or (e) use the Service to break any law. We may suspend or terminate accounts that do.
6. No guarantee of exam results (please read)
The practice content is a study aid only. It is not affiliated with, endorsed by, or a substitute for any official exam or certifying body, and it does not reproduce official exam questions.
We do not guarantee that using the Service will result in passing any exam, achieving any score, or obtaining any certification, license, or credential.
Official exam content and requirements can change at any time and are outside our control. Exam outcomes depend on many factors, including your own preparation.
7. Pricing and payment
Prices are shown on the Service in U.S. dollars and may change; the price at checkout is the price you pay. Payments are processed by Stripe and are subject to Stripe’s terms. We do not receive or store your full card number.
8. Refunds
Refunds are governed by our Refund Policy, which is part of these Terms.
9. Content accuracy
We work to keep the content accurate and up to date but do not warrant that it is complete, current, or error-free. If you spot an error, please tell us at support@tikou.org.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TONSYNC STUDIO LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ITEM GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold Tikou harmless from claims arising out of your misuse of the Service or violation of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including 4–6, 8, 10–12, and 14–16) survive.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. For any dispute not subject to arbitration under Section 15, you and we agree to the exclusive jurisdiction of the state or federal courts located in Wyoming.
15. Dispute resolution; arbitration; class-action waiver
Please read this section carefully — it affects how disputes between you and us are resolved.
Any dispute or claim arising out of or relating to these Terms or the Service that we cannot resolve informally will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court with jurisdiction.
YOU AND TONSYNC STUDIO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.
The arbitrator may not consolidate more than one person’s claims. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@tikou.org with your name and a statement that you opt out; opting out affects no other part of these Terms. This section applies only to the extent permitted by law.
16. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.
17. Changes to these Terms
We may update these Terms. Material changes take effect when we post the updated version with a new "Last updated" date; continued use after that means you accept them.
